Terms of Sale

  1. Applicability of the terms of sale
    • These terms of sale shall apply as the terms of contracts of sale concluded between the buyer (hereinafter ‘the consumer’) and the company Sinine Salong OÜ (hereinafter ‘sinine.ee online store’) for purchases of goods (gift cards).
    • In addition to these terms, the legal relationships arising from the purchase of goods from the sinine.ee online store are regulated by the Law of Obligations Act, the Consumer Protection Act and other legislation of the Republic of Estonia.
    • The sinine.ee online store reserves the right to make changes in the terms of sale. Such changes shall be published on the website www.sinine.ee.
  2. Prices
    • All prices in the sinine.ee online store include 20% VAT.
    • Prices are valid from order finalisation until the expiry of the period for payment for the finalised order (3 days after order finalisation).
    • Legal relationships between the consumer and the sinine.ee online store arising from orders submitted before changes to the terms of sale or prices shall be handled according to the terms which applied during the finalisation of the order.
    • The sinine.ee online store reserves the right to make changes in sales prices. Such changes shall be published on the website www.sinine.ee.
  3. Order finalisation
    • Add the desired products (gift cards) to the shopping cart.
    • To finalise the order, first click on ‘Finalise order’ in the shopping cart.
    • On the order finalisation page, fill in the required fields and click on ‘Order with payment obligation’. Following this, the invoice will be displayed on the screen and you will be able to pay for the order conveniently via a bank link (Swedbank, SEB, Sampo, Nordea, etc.) or other bank payment solutions through a euro payment. The details required to make the euro payment along with any applicable taxes and additional fees will be listed on the invoice displayed on your screen after you have confirmed the order.
    • Take care to fill in the fields on the details and order confirmation page correctly.
    • Orders submitted through the online store are processed on business days (Mon–Fri 10.00–17.00). Orders submitted on Friday after 14.00 will be processed on the following Monday.
  4. Entry into force of the contract of sale
    • Under a contract of sale, the sinine.ee online store undertakes to deliver the goods which are available or will be produced or acquired by sinine.ee to the consumer as well as to ensure the transfer of ownership to the consumer, while the consumer undertakes to pay the amount indicated on the invoice for the goods to the sinine.ee online store and to receive the goods.
    • Unpaid orders shall be cancelled after 3 days from the finalisation of the order.
    • The contract of sale shall enter into force after receipt of the payment from the consumer to the bank account of the online store.
  5. Delivery
    • After the entry into force of the contract of sale, the sinine.ee online store shall process the order and send the goods to the e-mail address submitted by the consumer.
    • The delivery times indicated in the online store are valid from the moment of receipt of the payment for the order on the bank account of the online store.
    • In order to ensure timely delivery, take care to submit correct and valid delivery details when finalising the order.
  6. Force majeure
    • The sinine.ee online store shall not be liable for any damage caused to the customer or delays in delivery, if the damage or delay is due to circumstances which are outside the control of the sinine.ee online store or which could not be foreseen.
  7. Processing of personal data
    • Upon entering data in the online store and confirming the order, the consumer grants sinine.ee permission to collect and process the consumer’s personal data (name, phone number, delivery and/or home address, e-mail address).
    • The sinine.ee online store has the right to use the consumer’s address to send marketing and other information to the consumer.
    • The consumer has the right to prohibit the collection and use of their personal data, except where it is necessary for the recovery of a claim arising from the contract or the delivery of the gift card.
    • Electronic personal data shall only be used for direct mailing if the consumer has consented to this separately on the website www.sinine.ee (link to direct mailing module).
    • The security of the consumer’s personal bank details when paying for orders is ensured through encrypted data communication with banks and such details are not accessible to the online store.
  8. Submission of complaints
    • The sinine.ee online store shall be liable to the consumer for any deficiencies and non-conformities of the goods with the terms of the contract discovered within 2 years of the delivery of the goods to the consumer.
    • Upon discovery of a deficiency, the consumer has the right to contact the sinine.ee online store within 2 months for redress by submitting the invoice used for payment for the purchased goods.
    • Upon discovery of a non-conformity of a product, please submit a complaint by e-mail to admin@sinine.ee, indicating the name and phone number of the person who submitted the order as well as the order number and a detailed description of the deficiency or non-conformity of the product.
    • Complaints regarding product deficiencies must be submitted within 2 months from the discovery of the non-conformity or deficiency of the product.
    • All complaints shall be reviewed and the consumer shall be contacted as soon as possible, but no later than 14 days following the receipt of the complaint.
    • The consumer has the right to demand a reduction in the purchase price or to terminate the contract and demand a refund from the sinine.ee online store, if the latter is unable to replace the goods, fails to repair or replace the goods, fails to eliminate the deficiency of the goods within a reasonable time or has caused unreasonable inconvenience to the consumer.
  9. Consumer’s right to appeal to the Consumer Disputes Committee
    • If the online store has refused to resolve the consumer’s complaint or if the consumer does not accept the solution offered by the online store and believes that the latter has violated their rights or damaged their interests, the consumer may submit a complaint to the Consumer Disputes Committee through the Estonian Consumer Protection Board or to a court of justice. The consumer may submit the complaint personally or through a representative. The contact details of the Consumer Disputes Committee are available on the website of the Estonian Consumer Protection Board. To resolve problems which have arisen in European Union countries, the consumer may contact the European Consumer Centre.
